Terms and Conditions of Sale

Article 1 — Purpose and Scope

These Terms and Conditions of Sale (hereinafter “T&Cs”) define the conditions under which Unobsoless SAS (hereinafter “Unobsoless” or “the Provider”), registered with the Paris Trade and Companies Register under number [to be completed], with its registered office at [address to be completed], offers and provides its professional obsolescence diagnostic and AI-assisted reskilling services to its users (hereinafter “the Client” or “the User”).

These T&Cs apply to any subscription or purchase of services made on the website accessible at https://unobsoless.ai (hereinafter “the Site”). They constitute the sole basis of the commercial relationship between the parties.

Any order or subscription to a paid service implies the Client's unreserved acceptance of these T&Cs. The User acknowledges having read and accepted these T&Cs by checking the box provided for this purpose during the ordering process, before validating payment.

Unobsoless reserves the right to modify these T&Cs at any time. The applicable T&Cs are those in effect on the date of the order. Any modification will be notified to Users by email or by display on the Site.

Article 2 — Description of Services

Unobsoless offers an online platform enabling professionals to assess their risk of obsolescence in the face of artificial intelligence and receive personalized reskilling and upskilling recommendations. The services offered are as follows:

a) Scan (free, no commitment)

The Scan service consists of a 10-question diagnostic questionnaire to assess the User's professional obsolescence index. This service is entirely free and requires no prior registration or payment method. The User receives an overall score out of 100 along with their risk zone (Protected, Stable, Vigilant, Exposed, Critical). Access to dimension details and personalized recommendations requires subscribing to a paid service.

b) Decode (EUR 19.99 incl. tax — one-time payment)

The Decode service provides a detailed AI-generated analysis report. This report includes: an in-depth analysis of the 6 dimensions of the obsolescence score, a sector comparison, identification of the top 5 priority skills to develop, training and resource recommendations, and an executive summary. The report is generated within 60 seconds after payment and is accessible from the User's dashboard. It can also be downloaded as a PDF.

c) Reboot (EUR 49.99 incl. tax — one-time payment)

The Reboot service includes all Decode content, plus a personalized 4-month (16-week) reskilling plan. This plan includes: weekly objectives, a custom training pathway, career evolution scenarios with compatibility estimates, analysis of high-potential adjacent roles, CV transformation recommendations, and interview preparation. The plan is generated by artificial intelligence and personalized based on the User's diagnostic questionnaire responses.

d) Shield (EUR 9.99/month incl. tax — monthly subscription)

The Shield service is a monthly subscription offering continuous monitoring of the User's obsolescence index. It includes: monthly score updates, alerts on AI-related developments in the User's sector, personalized AI monitoring, and early access to new platform features. The subscription has no commitment and can be cancelled at any time.

e) Transform (EUR 499/month incl. tax — monthly subscription)

The Transform service is a comprehensive 6-month professional transformation program. It includes all Shield content, plus: personalized AI coaching with individual follow-up, exclusive monthly masterclasses, access to a community of transitioning professionals, and Unobsoless certification attesting to acquired skills. The subscription has no commitment and can be cancelled at any time.

Article 3 — Prices and Payment Terms

Service prices are displayed in euros, inclusive of all taxes (TTC), on the Site and in these T&Cs. The applicable VAT is the French VAT in effect at the time of the order.

Unobsoless reserves the right to modify its prices at any time. The prices applicable to an order are those in effect at the time of payment validation by the Client. For ongoing subscriptions, any price change will be notified to the Client with 30 days' notice before the next renewal date. The Client may then choose to cancel their subscription before the new rate takes effect.

Payments are made exclusively electronically via the secure Stripe platform. Accepted payment methods include: credit/debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, and SEPA transfers. Unobsoless never stores the Client's credit card numbers, as these are processed directly and exclusively by Stripe.

For one-time payment services (Decode, Reboot), payment is due in full at the time of the order. For subscription services (Shield, Transform), the first payment is due at the time of subscription, then on each monthly anniversary date.

An electronic invoice is automatically generated and sent by email to the Client after each payment. Invoices are also accessible from the Client's dashboard.

Article 4 — Right of Withdrawal

In accordance with Articles L.221-18 and following of the French Consumer Code, the consumer Client has a period of fourteen (14) days from the date of purchase to exercise their right of withdrawal, without having to justify reasons or pay penalties.

To exercise their right of withdrawal, the Client must send their request by email to contact@unobsoless.ai, clearly stating their intention to withdraw, accompanied by their name, registration email address, and the reference of the order concerned.

In the event of exercise of the right of withdrawal within the aforementioned period, Unobsoless will refund the Client the full amount paid, free of charge, within a maximum period of fourteen (14) days following receipt of the withdrawal request. The refund will be made using the same payment method used for the initial transaction, unless otherwise agreed with the Client.

In accordance with Article L.221-28 of the French Consumer Code, the Client is informed that the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium whose performance has begun with the consumer's prior express consent and express waiver of the right of withdrawal. However, Unobsoless voluntarily grants a 14-day satisfaction guarantee on all its services, including digital content already generated.

Article 5 — 14-Day Satisfaction Guarantee

Independently of the legal right of withdrawal, Unobsoless offers a fourteen (14) day satisfaction guarantee on all its paid services. If the Client is not satisfied with the purchased service, they may request a full refund within 14 days of purchase, without having to provide justification.

The refund request under the satisfaction guarantee must be sent by email to contact@unobsoless.ai. The refund will be processed within 14 business days of receiving the request.

Article 6 — Digital Service Delivery

Unobsoless services are digital services delivered online. After payment validation, services are immediately accessible from the User's dashboard on the Site.

For Decode and Reboot services, the personalized report is automatically generated by artificial intelligence within a typical timeframe of 30 to 60 seconds after payment. In case of high traffic or technical difficulties, this timeframe may exceptionally reach 5 minutes. The User is notified by email when their report is available.

No physical delivery is made. Reports can be viewed online and downloaded in PDF format. The Client is solely responsible for backing up their downloaded reports.

Article 7 — Subscriptions: Renewal and Cancellation

Shield and Transform services are offered as automatically renewing monthly subscriptions. At the end of each monthly period, the subscription is automatically renewed for an identical period, unless cancelled by the Client.

The Client may cancel their subscription at any time, without fees or penalties, from their dashboard (Settings > Subscription > Manage subscription) or by email to contact@unobsoless.ai. Cancellation takes effect at the end of the current monthly period. The Client continues to benefit from the service until the end of the already paid period.

No pro-rata refund will be made for remaining days of the current period at the time of cancellation. The Client will no longer be charged from the next billing cycle following cancellation.

Unobsoless reserves the right to suspend or cancel a Client's subscription in case of non-payment, fraudulent use, or violation of these T&Cs, after a formal notice that has remained without effect for 15 days.

Article 8 — Liability and Limitations

The services offered by Unobsoless are AI-based decision-support tools. The results, scores, reports, and recommendations provided are generated by algorithms and AI models and do not constitute professional advice in career guidance, employment, training, or labor law. They are provided for informational and indicative purposes only.

Unobsoless undertakes to use all reasonable means to ensure the reliability and quality of its services. However, Unobsoless does not guarantee the accuracy, completeness, or relevance of results generated by artificial intelligence. The User uses the services and makes professional decisions at their own risk.

Unobsoless's liability is in any event limited to the total amount paid by the Client during the last 12 months for the services concerned. Unobsoless shall in no case be held liable for indirect damages, loss of revenue, loss of professional opportunities, or moral damages resulting from the use of its services.

Unobsoless shall not be held liable for temporary service interruptions related to maintenance operations, updates, or circumstances beyond its reasonable control.

Article 9 — Intellectual Property

All elements of the Site (texts, images, graphics, logo, icons, software, databases, algorithms, AI models, generated content) are the exclusive property of Unobsoless or are subject to a license of use. They are protected by French and international intellectual property laws.

Reports generated by the platform on behalf of the Client are granted under a personal, non-exclusive, and non-transferable license of use. The Client may download, print, and share their own reports for personal or professional use. It is strictly prohibited to reproduce, redistribute, resell, or commercially exploit reports or any other content from the Site without prior written authorization from Unobsoless.

The Client retains ownership of their personal data and responses provided during the diagnostic questionnaire. By using the service, the Client grants Unobsoless the right to use this data in an anonymized and aggregated manner for service improvement and statistical research purposes, in accordance with the privacy policy.

Article 10 — Personal Data

Unobsoless collects and processes the Client's personal data in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act. The terms of collection, processing, storage, and protection of personal data are detailed in the Privacy Policy, which forms an integral part of these T&Cs.

The Client has the right to access, rectify, delete, port, and object to the processing of their personal data, which they may exercise at any time by contacting Unobsoless at contact@unobsoless.ai or from their dashboard settings.

Article 11 — Applicable Law and Jurisdiction

These T&Cs are governed by French law. Any dispute relating to their interpretation, execution, or termination shall be subject to the exclusive jurisdiction of the Paris courts, subject to mandatory legal provisions applicable to consumers (Article R. 631-3 of the French Consumer Code).

In accordance with the provisions of the French Consumer Code concerning amicable settlement of disputes, the consumer Client has the right to use the mediation service offered by Unobsoless free of charge. The designated consumer mediator is: [mediator to be designated]. The Client may also file a complaint on the European online dispute resolution platform accessible at: https://ec.europa.eu/consumers/odr.

Article 12 — Consumer Mediation

In the event of a dispute not resolved directly with Unobsoless customer service, the consumer Client may use a consumer mediator free of charge under the conditions provided for in Articles L.611-1 et seq. and R.612-1 et seq. of the French Consumer Code.

The consumer mediator designated by Unobsoless is: [mediator to be designated, with full contact details and website]. The Client may refer the matter to the mediator within a maximum period of one year from their written complaint to Unobsoless.

Before referring the matter to the mediator, the Client must first have attempted to resolve the dispute directly with Unobsoless by sending a written complaint to contact@unobsoless.ai.

Article 13 — Force Majeure

Neither party shall be held liable for the non-performance or delay in the performance of any of its obligations described in these T&Cs that would be due to a case of force majeure within the meaning of Article 1218 of the French Civil Code.

Events considered as force majeure include, but are not limited to: natural disasters, epidemics or pandemics, wars, acts of terrorism, general strikes, fires, floods, power or telecommunications outages, large-scale cyberattacks, failures of infrastructure providers (Vercel, Stripe, Supabase), legislative or regulatory changes making service execution impossible, and more generally any unforeseeable, irresistible, and external event.

In the event of a force majeure event, the performance of obligations shall be suspended for the duration of the event. If the force majeure event continues beyond a period of three (3) months, either party may terminate the contract by operation of law, without compensation, by registered letter with acknowledgment of receipt or by email with read confirmation.

Article 14 — Severability

If any provision of these T&Cs is declared null or unenforceable by virtue of a law, regulation, or following a final decision by a competent court, that provision shall be deemed unwritten and the other provisions shall remain in full force and effect.

The parties shall endeavor, as soon as possible and in good faith, to replace the annulled provision with a valid provision consistent with the spirit and purpose of these T&Cs.
